Terms of Service

These General Conditions of Sale (hereinafter the "Conditions") exclusively govern the contractual relations between the Novaé brand, owned by the company TOMO LLC, whose headquarters are located at 2105 Vista Oeste St NW, Albuquerque, NM 87120, (hereinafter "Brand Name") and its consumer customers (hereinafter "the Buyer").

1 – Definitions


Any natural or legal person purchasing products for non-professional purposes.

Personal space created on the site.

Item sold by Novaé.

Novaé e-commerce platform.

Any person browsing the Site.

2 – Object

These Terms govern the sale of Products between Novaé and the Buyer. They prevail over any other documentation unless otherwise agreed in writing. They are accessible at any time on the Site and may be modified at any time.

3 – Customer Account

Creating an account is optional. It allows for easy tracking of orders. The Buyer is responsible for maintaining the confidentiality of their login details.

4 – Order

4.1 Placing an order

Orders are placed exclusively on the Site. The Buyer validates their shopping cart, provides their information, chooses their delivery method, and pays online. The order is confirmed by email.

4.2 Refusal of order

Novaé may refuse an order in the event of a dispute, non-payment, bank refusal or abnormal behavior.

5 – Products

5.1 Information

Descriptions are for guidance only. Visuals are not contractually binding.

5.2 Availability

In the event of a stock shortage, the Buyer will be informed. They can obtain a refund for the unavailable product within 30 days.

6 – Rates and billing

Prices are in euros, including VAT. Delivery charges and other optional services are indicated before the order is confirmed. An invoice is sent to the Buyer by email.

7 – Payment

Payment is due upon ordering. Payment is made by credit card or other secure method offered on the Site.

8 – Delivery

8.1 Terms and Conditions

Delivery is made to the address indicated by the Buyer. Risks are transferred upon delivery to the carrier. In the event of a return due to an incorrect address, reshipping is the responsibility of the Buyer.

8.2 Deadlines

9 – Transfer of ownership

Ownership is transferred to the Buyer after full payment. In the event of non-payment, Novaé may reclaim the products.

10 – Guarantees

10.1 Compliance

The Buyer benefits from the legal guarantee of conformity for 2 years.

10.2 Hidden defects

The warranty against hidden defects applies for 2 years after discovery of the defect.

11 – Security fault

Any damage caused by a product defect is the responsibility of the manufacturer.

12 – Suspension and termination

In the event of a breach by the Buyer, Novaé may suspend or terminate the contract after a formal notice has remained unsuccessful for 7 days.

13 – Right of withdrawal

The Buyer has 30 days from receipt to withdraw. Return shipping is at their expense. Refunds will be issued within 14 days of receipt of the returned product.

14 – Exchanges and refunds

The Buyer may request an exchange or refund within 30 days of receipt. The product must be returned in its original condition. The return is validated by Customer Service.

15 – Responsibility

Novaé is not responsible for damages related to improper use of the products. The Buyer is responsible for the choice and use of the products.

16 – Force majeure

In the event of an unforeseeable and irresistible event preventing the execution of the contract, the obligations are suspended. If the impediment lasts more than 3 months, the contract may be terminated.

17 – Intellectual property

All elements of the Site (texts, visuals, etc.) are the property of Novaé. Any unauthorized reproduction is prohibited.

18 – Personal data

The Buyer's data is processed in accordance with the Site's privacy policy.

19 – Mediation

In the event of an unresolved dispute, the Buyer may use the European dispute resolution platform: https://ec.europa.eu/odr

20 – Partial nullity

If a clause is declared invalid, the other provisions remain in force.

21 – Non-waiver

Failure to exercise a right does not constitute a waiver of that right.

22 – Titles

The headings are indicative and do not affect the interpretation of the clauses.
